U.S. OpenTable Diner Loyalty Program Terms

These updated OpenTable Rewards Program Terms (these “Reward Program Terms”) will become effective on March 31, 2018. The previous OpenTable Dining Rewards Terms and Conditions available here will continue to apply until March 30, 2018. By continuing to use OpenTable on or after March 31, 2018, users are agreeing to these Reward Program Terms.
It is your responsibility to read and understand the terms regarding the OpenTable Rewards program, outlined below. OpenTable may update or revise these Reward Program Terms from time to time. You agree that you will review these Reward Program Terms periodically. You are free to decide whether or not to accept a modified version of these Reward Program Terms, but accepting these Reward Program Terms, as modified, is required for you to continue using the content, features, and services (the “Services”) made available by OpenTable. You may have to click “accept” or “agree” to show your acceptance of any modified version of these Reward Program Terms. If you do not agree to these Reward Program Terms or any modified version of these Reward Program Terms, you must terminate your use of the Services, in which case you will no longer have access to your OpenTable account.

How Do I Join the OpenTable Rewards Program?

  • For eligible members, joining the OpenTable Rewards program is easy. Simply become a registered OpenTable member by creating an OpenTable account and follow any applicable instructions for joining the program.
  • The OpenTable Rewards program may not be available in all jurisdictions.

How Do I Collect Dining Points?

  • Only eligible, registered OpenTable members can participate in the OpenTable Rewards program and collect Dining Points. To collect Dining Points, an eligible member must first sign into his or her OpenTable account and make a reservation that is initiated on an OpenTable website, mobile site or app (each, an “OpenTable Site” and collectively, the “OpenTable Sites”). The member can then collect the number of Dining Points, if any, indicated when he or she made the reservation on an OpenTable Site after the dining party has honored the reservation and paid for the meal. If a reservation is eligible for Dining Points, OpenTable will disclose the number of Dining Points associated with that reservation through means such as displaying the number of Dining Points on the reservation detail and confirmation pages or the reservation confirmation email.
  • OpenTable reservations that are not initiated on an OpenTable Site are not eligible for Dining Points.
  • As noted above, an eligible member may only collect Dining Points for reservations made while signed into the member’s OpenTable account on an OpenTable Site.
  • If a member needs to modify a reservation, the change should be made online through an OpenTable Site, up to thirty (30) minutes prior to the reservation time — rather than by calling the restaurant – in order for any applicable Dining Points to be collected for the modified reservation.
  • OpenTable does not award Dining Points if a member or dining party is unable, for any reason, to make or honor an online reservation. Reasons a member may be prevented from making a reservation online include, but are not limited to:
    • technical difficulties
    • restaurant does not accept online reservations for the requested party size
    • restaurant is closed
    • restaurant does not take reservations that far in advance
  • Members will not collect any Dining Points when a reservation is canceled or the member or dining party does not show up for the reservation.
  • Unless otherwise stated, Dining Points will not be awarded for reservations for which rewards under the OpenTable Rewards program are redeemed.
  • Opportunities to collect Dining Points, and the amount of Dining Points collectable for any restaurant or particular reservation or other activity, may change from time to time at OpenTable’s sole discretion.

Do My Dining Points Expire?

  • Subject to the other provisions of these Reward Program Terms, Dining Points collected before March 31, 2018 will expire at 11:59 pm Pacific Time on March 31, 2021.
  • Subject to the other provisions of these Reward Program Terms, Dining Points collected on or after March 31, 2018 will expire three years from the end of the calendar quarter in which such Dining Points were collected. For example, Dining Points collected by a member on January 1, 2019 will expire at 11:59 pm Pacific Time on March 31, 2022.
  • If in any 12-month period an OpenTable member does not collect any Dining Points for a reservation made on an OpenTable Site, then all of the member’s collected Dining Points shall be forfeited, and his or her OpenTable membership may be subject to termination.

How Do I Redeem Dining Points?

OpenTable offers different rewards for which you can redeem your Dining Points.

  • Redemption options and methods may change from time to time at OpenTable’s sole discretion.
    To redeem your Dining Points, please log into your OpenTable account on the OpenTable website (from your desktop or laptop).
  • All redemptions are final.
  • To redeem Dining Points for certain rewards, you may be required to make a reservation.
  • The number of Dining Points required to be redeemed for different rewards may vary and will be determined in OpenTable’s sole discretion.
  • Redemption of Dining Points for Dining Rewards are subject to the Dining Rewards Terms available here.

Additional Terms

  • OpenTable reserves the right to terminate the OpenTable Rewards program, or to change the terms, regulations or benefits of participation of such program, in whole or in part, at any time with or without notice, even though changes may affect the number or value of Dining Points already collected or the availability or value of redemption options.
  • OpenTable may also modify the number of Dining Points required for redemption or withdraw, limit, change, or cancel the number, value or type of rewards or redemption options offered. OpenTable will make the final determination (in its sole and absolute discretion) should any disputes over Dining Points or redemption options arise.
  • OpenTable reserves the right to terminate a member’s OpenTable account and cancel any or all collected Dining Points if OpenTable believes, in its sole discretion, that the member is abusing the OpenTable Rewards program or is misrepresenting any information furnished to OpenTable.
  • If a member or dining party is unable to honor a reservation and fails to cancel in advance, OpenTable will send the member who made the reservation an email stating that OpenTable’s records indicate there was a no-show. If a member’s account accumulates four (4) no-show reservations within a twelve-month period, OpenTable will cancel that member’s OpenTable account and all collected Dining Points.
  • Should OpenTable offer rewards from or through any partners, OpenTable will not be responsible for any partner’s participation in or withdrawal from the OpenTable Rewards program.
  • Dining Points collected in two or more different OpenTable accounts (other than accounts under OpenTable’s Administrative Assistant and/or Concierge programs) cannot be combined for redemption.
  • Members are solely responsible for any tax liability related to participation in the OpenTable Rewards program.
  • Inquiries regarding Dining Points assigned to a reservation must be submitted via email within 14 days after the date of the reservation in order to be considered for review by OpenTable.
  • These Reward Program Terms are a part of our Terms of Use and such Terms of Use are incorporated by reference herein.

Canada OpenTable Diner Loyalty Program Terms

It is the OpenTable member’s responsibility to read and understand the terms and conditions regarding Dining Rewards, outlined below.

  • OpenTable reserves the right to terminate Dining Rewards, or to change these Terms and Conditions, regulations, or benefits of participation, in whole or in part, at any time with or without notice, even though changes may affect the number of Dining Points already accumulated. OpenTable may also withdraw, limit, modify or cancel the number of Dining Points required for reward redemption or change the number or type of reward offered. OpenTable will have final decision should any disputes over Dining Rewards or the awarding of Dining Points arise.
  • OpenTable reserves the right to terminate a member’s Dining Rewards’ account and cancel accrued Dining Points if OpenTable believes, in its sole discretion, that the member is abusing the Dining Rewards program, or is misrepresenting any information furnished to OpenTable.
  • Any OpenTable member who fails at any time to earn Dining Points for a period of twelve (12) months is subject to termination of his or her membership and forfeiture of all accrued Dining Points. See above rule for more detail.
    Expiring points will not affect pending dining check redemption mailings (i.e. if a member already redeemed points and has a dining check “in process” it will still be mailed).
  • If a dining party is unable to honor a reservation and fails to cancel, OpenTable will send the member an email stating that our records indicate there was a no-show. If a member’s account accumulates four (4) no-show reservations within a twelve-month period, OpenTable will cancel that member’s account and cancel all accrued Dining Points.
  • Should OpenTable offer rewards from any partners, OpenTable will not be responsible for any partner’s participation in or withdrawal from Dining Rewards.
  • Dining Points earned by a member in two or more different accounts cannot be combined to redeem any award (not applicable to OTAdmin and OTConcierge).

Die folgenden allgemeinen Geschäftsbedingungen des OpenTable Dining Rewards-Programms gelten für Ihre Mitgliedschaft im Dining Rewards-Programm („Dining Rewards“) und werden zwischen Ihnen (“Mitglied”) und OpenTable [Gmbh, Zeil 109, 60313 Frankfurt Deutschland] (“OpenTable“) vereinbart.

1. Regeln zur Teilnahme am Dining Rewards-Programm und zum Erwerb von

Vergütungspunkten

  1. Nur registrierte OpenTable-Mitglieder sind berechtigt, am Dining Rewards-Programm teilzunehmen und Vergütungspunkte zu sammeln. Um teilzunehmen, können Sie einfach kostenlos Mitglied bei OpenTable werden, indem Sie ein Profil eröffnen. Mitglieder erwerben – soweit nicht anders in den Reservierungshinweisen und Bestätigungsseiten auf www.opentable.de angegeben – 100 OpenTable-Punkte für jede Reservierung, die auf www.opentable.de getätigt wird. Die OpenTable-Punkte werden erst gutgeschrieben, wenn die Reservierung abgeschlossen ist (d.h., wenn der Kunde seine Reservierung wahrgenommen und für die Bewirtung bezahlt hat). Bei Stornierungen oder Nichterscheinen werden keine OpenTable-Punkte vergeben.
  2. Soweit nicht ausdrücklich anders angegeben, werden OpenTable-Punkte ausschließlich für Reservierungen vergeben, die entweder auf www.opentable.de oder über die assoziierten mobilen Applikationen für Android®- oder iOS®-fähige Mobiltelefone getätigt wurden. Reservierungen, bei denen OpenTable-Punkte gesammelt werden können, enthalten sowohl in den Reservierungshinweisen als auch in der Bestätigungs-E-Mail Angaben zur jeweiligen Anzahl der OpenTable-Punkte, die im Rahmen der Reservierung vergeben werden. Bitte beachten Sie, dass OpenTable-Punkte nur zu bestimmten Uhrzeiten und nicht an Sonntagen und gesetzlichen Feiertagen oder in Verbindung mit anderen Angeboten und Werbeaktionen gesammelt werden können. Es müssen mindestens zwei Personen bewirtet und mindestens eine Vorspeise pro Person bestellt werden.
  3. Ihren aktuellen Punktestand können Sie auf der OpenTable-Website unter “Mein Profil” einsehen, indem Sie sich einloggen. Sie werden benachrichtigt, sobald Sie genug Punkte gesammelt haben, um diese für einen Amazon.de Geschenkgutschein einzulösen.
  4. Falls ein Mitglied eine Reservierung ändern möchte, sollte dies online unter www.opentable.de oder über die assoziierten mobilen Applikationen für Android®- oder iOS®-fähige Mobiltelefone sowie mindestens 30 Minuten vor der reservierten Uhrzeit erfolgen, um sicherzustellen, dass die entsprechenden OpenTable-Punkte vergeben werden können. Bitte beachten Sie, dass keine Vergütungspunkte für eine Reservierung gesammelt werden können, wenn Sie direkt beim Restaurant anrufen, um eine online getätigte Reservierung zu ändern.
  5. OpenTable ist in keinem erdenklichen Fall verpflichtet, OpenTable-Punkte zu vergeben, wenn ein Mitglied oder Gast aus eine Reservierung nicht vornehmen oder wahrnehmen kann. Nicht ausschließliche Gründe hierfür können unter anderen sein:
    • Technische Schwierigkeiten,
    • das Restaurant akzeptiert keine Online-Reservierung für die angefragte Personenanzahl,
    • das Restaurant ist geschlossen und
    • das Restaurant nimmt keine Reservierungen mit der gewünschten Vorlaufzeit an.
  6. Mitglieder erhalten keine OpenTable-Punkte, wenn eine Reservierung storniert wird oder die Gäste nicht erscheinen.
  7. OpenTable-Punkte, die ein Mitglied in zwei oder mehreren Profilen erworben hat, können nicht miteinander kombiniert werden, um einen Amazon.de Geschenkgutschein zu erhalten (dies gilt nicht für OTAdmin und OTConcierge-Mitgliedschaften).

2. Einlösen von OpenTable-Punkten für Amazon.de Geschenkgutscheine und Gültigkeitsdauer von Amazon.de Geschenkgutscheinen

  1. Sobald Sie genug OpenTable-Punkte gesammelt haben, um diese für einen Amazon.de Geschenkgutschein einlösen zu können, wird Ihnen auf Ihrer „Mein Profil“-Seite die Option „Punkte einlösen“ angezeigt, sobald Sie sich einloggen. Klicken Sie einfach auf „Punkte einlösen“, um Ihre Bestellung aufzugeben.
  2. Von OpenTable versandte Amazon.de Geschenkgutscheine unterliegen den Geschäftsbedingungen von Amazon.de welcher unter dem folgenden Link eingesehen werden können: http://www.amazon.de/gp/help/customer/display.html?nodeId=505048#Nutzungsbedingungen

3. Kündigung des Programms und Verfall von OpenTable-Punkten

  1. OpenTable ist berechtigt, das Dining Rewards-Programm mit einer Frist von zwei Wochen zu kündigen. In diesem Fall behalten die bereits gesammelten OpenTable-Punkte noch für einen Zeitraum von zwölf Monaten nach Kündigung ihre Gültigkeit. Dies gilt allerdings nicht, wenn das Dining Rewards-Programm aus wichtigem Grund nach Ziffer 3 (3) gekündigt wird.
  2. OpenTable behält sich das Recht vor, die Anzahl von OpenTable-Punkte, die für den Erwerb einer Prämie erforderlich sind, sowie die Anzahl oder Art der angebotenen Prämien zu ändern, soweit Mitglieder hierdurch nicht wider Treu und Glauben benachteiligt werden. Wenn OpenTable Prämien von Partnern anbietet, ist OpenTable nicht für die dauerhafte Teilnahme dieser Partner am Dining Rewards-Programm oder deren Rückzug aus dem Dining Rewards-Programm verantwortlich.
  3. OpenTable behält sich das Recht vor, das Profil eines Mitglieds aus wichtigem Grund zu kündigen (und bereits gesammelte OpenTable-Punkte zu löschen). Ein wichtiger Grund, der OpenTable zur Kündigung einer Mitgliedschaft berechtigt, liegt insbesondere dann vor, wenn ein Mitglied das Dining Rewards-Programm missbräuchlich nutzt oder gegenüber OpenTable falsche Angaben macht.
  4. Bereits gesammelte OpenTable-Punkte verfallen, wenn ein OpenTable-Mitglied innerhalb eines Zeitraums von zwölf aufeinanderfolgenden Monaten keine OpenTable-Punkte gesammelt hat.
  5. Der Verfall von Punkten hat keinen Einfluss auf die Versendung von bereits eingelösten Amazon.de Geschenkgutscheinen (d.h., wenn ein Mitglied bereits Punkte eingelöst hat und der Amazon.de Geschenkgutschein „in Bearbeitung“ ist, wird dieser trotzdem versendet).
  6. Im Falle einer nicht wahrgenommenen Reservierung, sendet OpenTable dem Mitglied eine E-Mail mit einem Hinweis auf die verpasste Reservierung. Wenn ein Gast innerhalb von zwölf Monaten viermal trotz getätigter Reservierung nicht erscheint, ist OpenTable berechtigt, das Profil dieses Mitglieds zu schließen und bereits gesammelte OpenTable-Punkte zu löschen.

4. Anzuwendendes Recht und andere Bestimmungen

  1. Die allgemeinen Geschäftsbedingungen des OpenTable Dining Rewards-Programms unterliegen deutschem Recht.
  2. Für jegliche steuerlichen Verpflichtungen, die sich im Zusammenhang mit der Teilnahme am Dining Rewards-Programm ergeben, sind ausschließlich die Mitglieder verantwortlich.

Japan OpenTable Diner Loyalty Program Terms

OpenTable 登録会員(以下「会員」といいます。)は、予め本規約に同意した上で、本プログラムを利用するものとします。

OpenTable ダイニング リワード ポイントについての規則

  • OpenTable に登録された会員の方のみが、ダイニング リワード プログラムに参加することができ、ダイニング リワード ポイントを獲得することができます。特に明記しない限り、会員は www.opentable.jp 予約サイト上でオンライン予約の手続きを開始および完了し、予約を厳守して来店した場合につき、100 ダイニング リワード ポイントを得ることができます。予約が完了(お食事のお客様が予約を厳守し、お食事の支払いを完了)されるまでは、ダイニング リワード ポイントは付与されません。
  • www.opentable.jp 予約サイト上で予約の手続きが開始および完了されなかった OpenTable オンライン予約は、ダイニングポイントの対象となりません。(レストランの Web サイト、パートナー サイトなどから予約の手続きを開始した場合、対象外となります。)ご予約がポイントを得られる対象である場合、その予約に関連したポイント数がご予約詳細ページ、ご予約確認ページ、およびご予約確認メールに表示されます
  • 会員が予約を変更する必要がある場合、該当するダイニング リワード ポイントが確実に付与されるために、予約変更は予約時刻の 30 分前までに、レストランへの電話連絡ではなく、オンラインで www.opentable.jp 予約サイトにて行われる必要があります。
  • 会員またはお食事をされるお客様が、理由の如何を問わず、オンライン予約を取得することができないまたは予約を厳守できない場合、OpenTable はダイニング リワード ポイントを付与する責任を負いません。会員がオンライン予約を行うことから妨げられることができる理由は、以下を含みますが、これに限定されるものではありません:
    • 技術的な問題
    • レストランが希望の人数でオンライン予約を受け付けることができない
    • レストランが営業していない(営業時間外、定休日、閉店など)
    • レストランの前もって予約できる日数を超えている
  • 予約がキャンセルされた場合、または、お食事をするお客様が予約に対して来店しなかった場合、会員はダイニング リワード ポイントを受け取れません

条件

  • OpenTable は、ダイニング リワード プログラムを終了する、または、変更がすでに蓄積されたダイニング ポイント数に影響を及ぼすことがあっても、通知の有無にかかわらずいつでも、これらの条件、規制または利益を、全部であるか一部であるかを問わず、変更する権利を保有します。OpenTable は、特典の引き換えのために必要とされるダイニング リワード ポイント数を引き出し、制限、修正、または取り消しすること、または、提供される特典の数または種類を変更することもできるものとします。ダイニング リワードまたはポイントの付与に関するあらゆる紛争が生じた場合、OpenTable が最終決定を行うものとします。
  • OpenTable が、その単独の自由裁量にて、会員がダイニング リワード プログラムを悪用しているか、または OpenTable に供給される情報を誤って伝えていると信ずる場合、OpenTable は会員のダイニング リワードのアカウントを停止して、既得のダイニング リワード ポイントを無効とする権利を保有します。
  • いつでも 12 ヵ月間、ダイニング リワード ポイントを取得しなかった OpenTable 会員は、会員資格の解除、およびすべての既得のダイニング リワード ポイントの喪失の対象となります。
  • ポイント失効は、引き替え中のギフトカードの送付には影響しません。(例: 会員がポイント引き替えの申し込みを終え、ギフトカードの送付が行われている最中の場合、ギフトカードは送付されます。)
  • お食事をするお客様が予約を厳守することができなく、キャンセルを怠った場合、OpenTable は会員に対して、当社の記録上では「連絡なしの無断キャンセル」(不参客)であったことを示す電子メールを送信します。会員が 12 ヵ月の期間内に「連絡なしの無断キャンセル」(不参客)を 4 回蓄積した場合、OpenTable はその会員のアカウントを停止して、すべての既得のダイニング リワード ポイントを無効にします。
  • OpenTable がパートナーからリワードを提供するならば、OpenTable は、いかなるパートナーのダイニング リワード プログラムへの参加または撤退に対して、一切責任を負いません。
  • 2 つ以上の異なるアカウントで会員によって得られたダイニングポイントは、リワードへの引き替えのために合算することはできません。
  • 会員は、ダイニング リワードへの参加に関連した租税義務に対して自己責任を負うものとします。
  • 予約に割り当てられたダイニング リワード ポイントに関しての照会・調査は、予約日後 14 日以内に、「ヘルプ ページ」内に記載されている所定の方法およびお問い合わせフォームを通して OpenTable へ提出されなければ、OpenTable による調査に考慮されません。
